Pursuant to the Credit Reporting Agencies (CRA) Act 2010 and Central Bank of Malaysia Act 2009, I/we consent that any company personal information collected or held by Bay Groups Holding Sdn Bhd ("CapBay") may be held and/or used by CapBay, and disclosed to CapBay's affiliates or any selected third party (including but not limited to regulators/authorities and credit reporting agencies such as CTOS Data Systems ("CTOS"), Experian Information Services ("Experian"), and Credit Bureau Malaysia ("CBM")). As such, I/we also hereby consent to the disclosure of credit information from CTOS, Experian, and/or CBM to CapBay and its subsidiaries.
By this consent, I/we understand and agree that:
I. You may conduct credit/trade checks including CCRIS checks on me/us and when consent has been given individually, on our directors, shareholders, guarantors, and other relevant parties. Such checks may be carried out with any selected third party at any time for as long as I/we have a trade relationship with you or while any amount remain due and outstanding to you, for any of the following purposes:
- Account Opening
- Debt Recovery
- Credit / Account Review
- Credit / Accounting Monitoring
- Credit / Account Evaluation
- Preparation of legal documentation arising from any contract or facility granted by you
II. I/We consent to your disclosure of information regarding the conduct of my/our account(s) with you to any business entity/ies for bona fide trade checking at any time.
III. I/We expressly consent and authorise you and your service providers to file trade references and report my/our payment conduct, including any overdue invoices or unpaid fees (including all fees due and payable to you), to any credit reporting agencies, including CTOS, Experian and CBM, for credit reporting purposes (if any). I/We also expressly consent and authorise you and your service providers, including CrediBill, to log a trade reference on the entity, the personal guarantors (if any), the sole proprietor, or any partner in the partnership, as applicable. I/We understand that any reporting to credit reporting agencies may be accessed by subscribers of those agencies and may affect my/our credit standing.
IV. Where processing of my/our application requires use of any processing centre located outside Malaysia (including your Head Office), I/we hereby consent to selected third parties disclosing my/our credit information except CCRIS, to such locations outside Malaysia.
V. I/We declare that the details provided are true and accurate. I/We acknowledge the right to obtain access to and request correction of any personal information held by CapBay by contacting billing@credibill.co and contact@capbay.com.
VI. I/We have read the Privacy Notice published at https://capbay.com/privacy-notice/ and understand the reasons for collection of my/our personal data and the ways in which the data may be used and disclosed.
VII. By providing my/our mobile phone number and e-mail address in this Form, I/we confirm and declare that the mobile phone number and e-mail address provided are under my/our sole and exclusive control and are accessible only by my/our authorised signatory and are not shared with or accessible to any unauthorized persons or third party. I/We further agree and acknowledge that any electronic signature created via the mobile phone number and/or e-mail address provided will be considered and treated as my/our authorized electronic signature for all purposes.
